Welcome to The Luxe Almari. These Terms of Service (“Terms”) govern your access to and use of our website and peer-to-peer marketplace (the “Platform”). By accessing or using The Luxe Almari, you agree to these Terms. If you do not agree, please discontinue use of the Platform.
SECTION 1 – OVERVIEW
This website is operated by The Luxe Almari. Throughout the site, “we”, “us”, and “our” refer to The Luxe Almari.
The Luxe Almari provides an online platform that allows users to buy and sell pre-loved clothing and accessories. We facilitate the connection between buyers and sellers, but we are not a party to transactions that occur between users.
Our store is hosted by Shopify Inc., which provides the e-commerce infrastructure through which we offer our services.
SECTION 2 – GENERAL CONDITIONS
We reserve the right to refuse service to anyone at any time.
Except for credit card information, content transmitted through the Platform may be transferred unencrypted across various networks and may be adapted to meet technical requirements. Credit card information is always encrypted during transfer.
You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Service without our express written permission.
Headings in this agreement are for convenience only.
SECTION 3 – ACCURACY, COMPLETENESS AND TIMELINESS OF INFORMATION
We are not responsible if information on the site is inaccurate, incomplete, or outdated. Content is provided for general information only.
We may update or change site content at any time but have no obligation to do so. You agree it is your responsibility to monitor the site for changes.
SECTION 4 – MODIFICATIONS TO THE SERVICE AND PRICES
Prices for items or services may change without notice.
We may modify or discontinue the Service at any time. We are not liable for any modification, price change, suspension, or discontinuance.
SECTION 5 – PRODUCTS OR SERVICES
Some products or services may be available exclusively online and in limited quantities.
While we strive to accurately display images and colours, we cannot guarantee exact accuracy on all devices.
We reserve the right to:
Limit sales of products or services
Limit quantities
Change product descriptions or pricing
Discontinue any product
We may reduce the price of any item up to 30% to encourage a sale, without requiring seller approval.
We do not guarantee that any product or service will meet expectations.
SECTION 5.1 – SELLER TERMS (THE LUXE ALMARI)
To ensure a high-quality marketplace, The Luxe Almari may reject any item that does not meet our listing standards:
Accepted items must be:
New or like-new condition
Free from significant defects
Clean and dry-cleaned (where relevant)
Photographed clearly on plain backgrounds
If an item does not qualify, the seller will be notified.
Seller Responsibilities
Sellers must:
List items accurately and disclose defects
Dry-clean items before listing
Ship sold items within 3 days of sale
Package items safely
Items not dry-cleaned or unsuitable may incur a £25 service fee and be returned at the seller’s expense.
If an item arrives at The Luxe Almari (for curation or managed listings), we will carry out quality checks. Items that fail will be returned at the seller’s cost.
Buyer Inspection Window
Once buyers receive an item, they have 48 hours to report:
Incorrect item
Item not as described
Item not delivered
Payouts to sellers are released after this window and may take up to 28 days to appear.
SECTION 5.2 – COMMISSION STRUCTURE (LUXE ALMARI)
The Luxe Almari commission structure may include:
Standard commission (e.g., seller receives 75%)
Commission for premium service packages
Minimum commission per item (£25)
We reserve the right to reduce prices by up to 30% to facilitate a sale.
Commission is automatically deducted before payout.
SECTION 5.3 – VIP / PREMIUM SELLER SERVICES (IF APPLICABLE)
For sellers using The Luxe Almari’s premium or concierge services:
Items may undergo valuation
Items may be displayed online and/or physically
Items may be promoted via social media, events, or stylists
Items are stored for the premium listing period
Sellers remain owners of their items but must allow The Luxe Almari exclusive selling rights for the agreed period.
The Luxe Almari is not liable for minor wear, try-on damage, or loss during the agreed consignment period.
If items remain unsold after the exclusive listing period:
Seller may collect the item
Storage fees may apply for uncollected items
The Luxe Almari may donate or discount items if uncollected after extended periods
SECTION 6 – ACCURACY OF BILLING AND ACCOUNT INFORMATION
We may refuse or limit any order.
Buyers must provide accurate and up-to-date account information.
SECTION 7 – OPTIONAL TOOLS
We may offer access to third-party tools. Use of such tools is entirely at the user’s own risk.
SECTION 8 – THIRD-PARTY LINKS
We are not responsible for third-party websites linked from our site or for their content, products, or services.
SECTION 9 – USER COMMENTS, FEEDBACK AND SUBMISSIONS
Any comments or submissions you send to us may be used freely without restriction.
You may not submit unlawful, offensive, or infringing content.
SECTION 10 – PERSONAL INFORMATION
Your submission of personal information is governed by our Privacy Policy.
SECTION 11 – ERRORS, INACCURACIES AND OMISSIONS
We may correct errors or update information at any time without notice.
SECTION 12 – PROHIBITED USES
You may not use the Platform for unlawful activities, harassment, IP infringement, spreading malware, data harvesting, or any behaviour that disrupts the Service.
We may terminate access for violations.
SECTION 13 – DISCLAIMER OF WARRANTIES; LIMITATION OF LIABILITY
The Platform is provided “as is” without warranties.
The Luxe Almari is not liable for:
Loss of profits or revenue
Damaged, lost or misdelivered items
Errors, interruptions, or downtime
Disputes between users
Indirect or consequential damages
Some jurisdictions do not allow such limitations, so they may not apply to you.
SECTION 14 – INDEMNIFICATION
You agree to indemnify The Luxe Almari from claims arising from:
Your use of the Platform
Your breach of these Terms
Your violation of others’ rights
SECTION 15 – SEVERABILITY
If any provision is unenforceable, the remaining provisions remain valid.
SECTION 16 – TERMINATION
You may stop using the Service at any time.
We may terminate access if we believe you have breached these Terms.
SECTION 17 – ENTIRE AGREEMENT
These Terms constitute the full agreement between you and The Luxe Almari.
SECTION 18 – GOVERNING LAW
These Terms are governed by UK law.
SECTION 19 – CHANGES TO THE TERMS
